Marriage In Costa Rica
Costa Rica has
been chosen by
many for that
perfect,
romantic
wedding, of
which memories
last forever.
Many celebrities
like Gisele
Bundchen and Tom
Brady, have
chosen a Costa
Rican wedding.
Getting married
in Costa Rica is
pretty easy. If
both the bride
and groom are
not Costa
Ricans, then
simply
contacting a
Costa Rican
attorney or
notary to
prepare the
documents of the
marriage and
then file it
with the civil
registry.
In Costa Rica,
notaries are
important as
they are the
only power to
validate
signatures and
make entries
directly to a
registry. While
all notaries are
attorneys, not
all attorneys
are notaries.
A valid passport
is the only
document
required.
In the case of
of either the
bride or groom
or both are
Costa Rican, the
requirements are
a little
differnet. In
such case the
following
documents are
required by the
Costa Rican
national:
1. The cedula
2. A copy
certifying civil
status from the
Registro Civil,
validating that
the person is
single.
If one of the
Costa Rican
spouses has been
married
previously, a
copy of the
divorce document
or death
certificate in
the case of a
dead spouse, is
also required.
In days past, a
Costa Rican
woman who wanted
to remarry would
have to wait at
least 300 days
from the date of
the divorce or
publication of
the former
spouse's death
certificate. The
reason for the
wait period is
to not incur
problems with
pregnancy. (300
days - nine
months). Men
were not
required to wait
to remarry.
The requirement
was changed in
2008, when the
Constitutional
Court (Sala IV)
said the wait
period was
unconstitutional
and that today
there are
methods
available, like
DNA, to
determine
parental
responsibility.
As such, both
women and men
can now remarry
the day
following a
divorce decree.
To make a
marriage
official in
Costa Rica, two
witnesses who
are
non-relatives
are required to
sign the
notary's
registry.
Although many
choose a
religious or
church wedding,
which is
currently in
decline over the
last decade, the
only legal
document
officiating the
marriage is the
document
provided by the
notary and
registered with
the Registro
Civil.
As such many
weddings are
performed at a
the lawyer or
notary's office,
one's home or on
the beach.
Marriages
legally
performed in
Costa Rica are
also valid in
other countries.
A certficate of
marriage issued
by the Registro
Civil in Costa
Rica and the
certifications
by the person
performing the
ceremony can be
used to register
the marriage in
the US or
Canada, for
example.
